Highlights This Week:
Supplemental Funds Remain in Limbo: On Monday, the Senate passed its own version of a supplemental appropriations bill. However, the bill suffered the same fate as legislation passed last week by the House of Representatives. The bill, HB 1524 (different from HB 1564 that passed the House without the emergency clause last week), contained $66 million in supplemental appropriations. The bill did not include $9 million for the endowed chairs program. Similar to the action in the House last week, the Senate vote of 28-18 in favor of the bill split strictly along party lines, with Democrats in support and Republicans in opposition. The bill's emergency clause failed on an identical 28-18 vote; passage of the emergency clause requires a two-thirds vote (32 votes). Without the emergency clause, the appropriations in the bill would not be available until 90 days following the end of the legislative session.
By the end of the week, Senate Democrats were considering the inclusion of supplemental funding items in the “general appropriations” bill. The Oklahoma Constitution allows the Legislature to pass one general appropriations bill that provides funding for all state agencies/entities as long as it does not increase employee salaries or fund additional employees. The unique feature of the general appropriations bill is that it does not need an emergency clause to become effective immediately. Therefore, House and Senate Democrats could pass the bill without any Republican votes. The Governor would then have the opportunity to “line-item” veto any funding items to which he objected.

Senate Passes Student Grant Program for Private Colleges: On Monday, the Senate passed SB 586, which would create the Oklahoma Tuition Equalization Grant Program. The program would provide $2,000 state-funded grants to full-time undergraduate students attending accredited, not-for-profit, private/independent colleges or universities in Oklahoma. The bill passed by a 28-4 vote. The title of the bill is “stricken” which means that the bill would have to come back to the Senate for at least one more vote before final approval. The estimated cost of the program is about $10 million.

Natural Gas Taxes Continue to Dominate State Revenue: On Tuesday, the Office of State Finance released its regular monthly report on state General Revenue collections. Through the first eight months of the current fiscal year, overall collections are running about 5.9% ahead of initial estimates. However, if not for the extraordinary natural gas tax collections, overall collections would actually be almost 1% below initial estimates. Through February, natural gas tax revenue is 147%, or $192 million, above expectations. You can view the report at: http://www.state.ok.us/osfdocs/news8-01.html
Legislative Activity Moves Back to Committees: Yesterday, Thursday, was the deadline for bills to be passed on the floor of their house of origin. All bills must now be passed from committee in the opposite house by Thursday, March 29 (House bills from Senate committee and vice versa). Next week we will remove those bills that did not survive yesterday’s floor deadline.
